These Terms & Conditions apply to your use of the Free Soul website and to any orders you place through our website. 

Please read these Terms carefully before using our website or placing an order. By using our website, creating an account, placing an order or purchasing a subscription, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our website or place an order. 

These Terms should be read alongside our Privacy Policy, Cookie Policy, Delivery Policy and Returns Policy.

1.1 This website is owned and operated by ARA FITNESS LIMITED, trading as Free Soul. 

1.2 We are registered in England and Wales under company number 10150642. 

1.3 Our registered office is Kings Head House, 15 London End, Beaconsfield, England, HP9 2HN. 

1.4 Our VAT number is 240487904.

2. Definitions 

2.1 In these Terms: 

“Free Soul”, “we”, “us” or “our” means ARA FITNESS LIMITED trading as Free Soul. 

“Website” means freesoul.com and any associated pages operated by us. 

“Products” means the products available to purchase through our Website. 

“Order” means an order placed by you through our Website. 

“Subscription” means a recurring order for Products selected by you. 

“You” or “your” means the person using our Website or placing an Order. 

 

3. Eligibility 

3.1 You must be at least 18 years old to use our Website, create an account, place an Order or purchase a Subscription. 

3.2 By using our Website or placing an Order, you confirm that you are legally capable of entering into a binding contract. 

 

4. Using our Website 

4.1 You agree that you will not: 

  • use our Website in any way that is unlawful, fraudulent or harmful; 

  • interfere with the security, availability or performance of our Website; 

  • introduce viruses, malware or any other harmful technology; 

  • scrape, data mine or otherwise collect information from our Website without our prior written consent; 

  • use our Website to send unsolicited marketing communications; 

  • impersonate another person or provide false, inaccurate or misleading information; or 

  • use our Website in any way that infringes the rights of Free Soul or any third party. 

4.2 We may suspend, restrict or terminate your access to our Website if we reasonably believe you have breached these Terms. 

 

5. Accounts 

5.1 You may need to create an account to place an Order, manage a Subscription or access certain features of our Website. 

5.2 You are responsible for keeping your login details confidential and for all activity that takes place under your account. 

5.3 You must ensure that the information in your account, including your name, delivery address, billing address and payment details, is accurate and kept up to date. 

5.4 If you become aware of any unauthorised use of your account, please contact us as soon as possible at hello@freesoul.com. 

 

6. Orders 

6.1 When you place an Order through our Website, you are making an offer to purchase the Products in your basket. 

6.2 Your Order is accepted when we send you an order confirmation email. At that point, a contract is formed between you and us. 

6.3 We reserve the right to reject or cancel an Order where: 

  • a Product is unavailable; 

  • there is an error in the price, description or availability of a Product; 

  • we are unable to authorise your payment; 

  • we reasonably suspect fraud, misuse or breach of these Terms; or 

  • we are unable to deliver to your address. 

6.4 If we cancel an Order after payment has been taken, we will refund you for the cancelled item or Order. 

 

7. Product information 

7.1 We try to ensure that all Product descriptions, images, ingredients, nutritional information, prices and availability details on our Website are accurate and up to date. 

7.2 Product images are for illustrative purposes only. Packaging, colours, labels or appearance may vary from the images shown on our Website. 

7.3 You should always check the Product packaging, ingredients, allergen information, directions for use and warnings before consuming or using any Product. 

 

8. Health and wellbeing information 

8.1 Information on our Website, including articles, product descriptions, guides, emails and social media content, is provided for general information only. 

8.2 Our content is not intended to diagnose, treat, cure or prevent any disease or health condition, and should not be treated as medical advice. 

8.3 You should speak to a qualified healthcare professional before using supplements or making changes to your diet, particularly if you are pregnant, breastfeeding, taking medication, have a medical condition or have any health concerns. 

 

9. Prices and payment 

9.1 Prices are shown in pounds sterling and include VAT where applicable, unless stated otherwise. 

9.2 Delivery charges, if applicable, will be shown at checkout before you place your Order. 

9.3 We may change Product prices at any time. Price changes will not affect Orders that we have already accepted, except where there has been an obvious pricing error. 

9.4 Payment must be made using one of the payment methods available at checkout. 

9.5 By submitting payment details, you confirm that you are authorised to use that payment method. 

 

10. Promotions, discounts and gifts 

10.1 From time to time, we may offer discount codes, promotional prices, free gifts, bundles or other offers. 

10.2 Promotions are subject to availability and may be amended or withdrawn at any time. 

10.3 Unless stated otherwise: 

  • promotions cannot be used in conjunction with any other offer; 

  • discount codes are valid for one use per customer; 

  • promotions have no cash value; 

  • promotions cannot be applied retrospectively to previous Orders; and 

  • where a free gift is offered subject to a minimum spend, the free gift may need to be returned if returning Products brings the Order below the qualifying spend. 

10.4 Additional terms may apply to specific promotions and will be displayed on the relevant page or offer. 

 

11. Delivery 

11.1 We will deliver Products to the delivery address you provide at checkout. 

11.2 Estimated delivery times are estimates only and are not guaranteed unless expressly stated. 

11.3 We are not responsible for delays outside our reasonable control, including courier delays, customs delays, adverse weather, strikes, technical issues or incorrect delivery information provided by you. 

11.4 You are responsible for ensuring your delivery address is complete and accurate. 

11.5 If an Order is delayed, lost or returned because you provided incorrect or incomplete delivery information, we may not be able to refund delivery charges or resend the Order free of charge. 

 

12. Returns, cancellations and refunds 

12.1 Your legal rights are not affected by these Terms. 

12.2 If a Product is faulty, not as described or not fit for purpose, you may be entitled to a refund, repair or replacement under UK consumer law. 

12.3 For most online purchases, consumers have cancellation rights. However, certain goods may be excluded, including sealed goods that are not suitable for return due to health protection or hygiene reasons once unsealed. 

12.4 Please refer to our Returns Policy for details of how to return Products, applicable timeframes and any exclusions. 

12.5 To request a return or refund, contact us at hello@freesoul.com with your order number and details of the issue. 

 

13. Subscriptions 

13.1 Free Soul Subscriptions allow you to receive selected Products on a recurring basis. 

13.2 When you purchase a Subscription, your first Order will be processed at checkout. Future Orders will be created and charged automatically according to the renewal plan linked to your Subscription. 

13.3 By purchasing a Subscription, you authorise us and our payment providers to take recurring payments from your selected payment method until your Subscription is cancelled, paused or otherwise ended in accordance with these Terms. 

13.4 Eligible Subscription Products may receive a recurring subscription discount as displayed on the Website. 

13.5 The discount, frequency options and Products available for Subscription may vary from time to time. Unless a specific offer states otherwise, Subscriptions do not have a minimum commitment. 

13.6 You can manage your Subscription through your Free Soul account. Depending on the available options, you may be able to change your delivery frequency, update your next order date, skip an order, pause your Subscription, update your address or payment details, change Products or flavours, or cancel your Subscription. 

13.7 You are responsible for keeping your account, delivery and payment details accurate and up to date. 

13.8 You will be charged for your first Subscription Order at checkout. Future Subscription Orders will be charged automatically using your saved payment method on or around your renewal date. 

13.9 We may send you a renewal reminder before your next Subscription payment is due. Our current process is to send this reminder three business days before payment is taken. 

13.10 If payment fails, we may retry payment, contact you via email to update your payment details, delay dispatch, pause your Subscription or cancel your Subscription. 

13.11 You may cancel, pause or skip your Subscription through your account. To avoid being charged for your next Subscription Order, you must make any changes before the relevant cut-off. Our current cut-off is one business day before renewal. If you cancel, pause or skip after the cut-off, your next Subscription Order may already have been processed and charged. In that case, your change may take effect from the following Subscription Order. 

13.12 Cancelling a Subscription stops future recurring Orders. It does not automatically cancel, refund or recall an Order that has already been processed, dispatched or delivered. 

13.13 We may change Product prices, delivery charges, Subscription discounts or Subscription availability from time to time. If a price change affects your existing Subscription, we will give you reasonable notice before the change takes effect. If you do not wish to accept the price change, you may cancel your Subscription before the new price applies. 

13.14 Subscription Products are subject to availability. If a Product in your Subscription is unavailable, discontinued or changed, we may offer a replacement, delay the Subscription Order, skip the affected Product or cancel the affected Subscription. Your statutory rights are not affected. 

 

14. User comments, reviews and submissions 

14.1 If you submit comments, reviews, feedback, images, videos, testimonials, social media content or other material to us, you confirm that: 

  • the material is your own original work or you have permission to share it; 

  • the material is accurate and not misleading; 

  • the material does not infringe anyone else’s rights; 

  • the material is not unlawful, abusive, defamatory, obscene or discriminatory; and 

  • the material does not contain viruses, malware or harmful code. 

14.2 You grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, publish, display and distribute the material for our business purposes, including marketing and promotional purposes. 

14.3 We may remove or edit user-submitted material at our discretion. 

 

15. Intellectual property 

15.1 All intellectual property rights in our Website and its content, including text, images, graphics, logos, icons, videos, product names, recipes, designs, layout and branding is protected by copyright, trade mark and other intellectual property laws. 

15.2 You may access and use our Website for personal, non-commercial purposes only. 

15.3 Unless otherwise stated, all rights in the Website and its content are owned by or licensed to ARA FITNESS LIMITED, trading as Free Soul. 

15.4 You may not copy, reproduce, modify, publish, distribute, sell, license, exploit or use any part of the Website or its content for commercial purposes without our prior written consent. 

 

16. Third-party links 

16.1 Our Website may contain links to third-party websites or services. 

16.2 We are not responsible for the content, accuracy, security, privacy practices or availability of third-party websites. 

16.3 Accessing third-party websites is at your own risk.

17.1 We process personal information in accordance with our Privacy Policy.

18. Availability of the Website 

18.1 We aim to keep our Website available and functioning properly, but we do not guarantee that it will always be available, uninterrupted, secure or error-free. 

18.2 We may suspend, withdraw, update or change all or part of our Website at any time.

19.1 Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. 

19.2 This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any other liability that cannot be excluded or limited by law. 

19.3 Subject to clauses 19.1 and 19.2, we are not liable for: 

  • loss caused by events outside our reasonable control; 

  • business losses, including loss of profit, revenue, business, opportunity or goodwill; 

  • loss or corruption of data; 

  • indirect or consequential loss; or 

  • your misuse of our Website or Products. 

19.4 These Terms do not affect your statutory rights as a consumer. 

 

20. Breach of these Terms 

20.1 If you breach these Terms, or we reasonably suspect that you have breached these Terms, we may: 

  • issue a warning; 

  • suspend or terminate your account; 

  • restrict or block your access to our Website; 

  • cancel Orders or Subscriptions; 

  • remove content submitted by you; and/or 

  • take legal action where appropriate. 

 

21. Changes to these Terms 

21.1 We may update these Terms from time to time. 

21.2 The updated version will apply from the date it is published on our Website, unless stated otherwise. 

21.3 You should check these Terms before placing an Order or purchasing a Subscription to ensure you understand the terms that apply at that time. 

 

22. Severability 

22.1 If any part of these Terms is found to be unlawful, invalid or unenforceable, the remaining parts will continue in full force and effect. 

 

23. Governing law and jurisdiction 

23.1 These Terms are governed by English law. 

23.2 Any disputes relating to these terms and conditions are subject to the exclusive jurisdiction of the courts of England.
